1. Agreement
These Terms of Service ("Terms") are an agreement between you and Orken ("we", "us") covering the Orken iOS app and the orken.app website (together, the "Service"). By downloading, installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Our Privacy Policy is part of these Terms.
2. Who can use Orken
You must be at least 13 years old to use Orken. If you are under the age of majority where you live, you may use Orken only with the involvement of a parent or guardian who agrees to these Terms. Some features — creating an account, joining challenges, purchasing a subscription — may require you to be 16 or older depending on your country.
3. Your account
Orken works fully without an account. If you create one, you agree to give accurate information, keep your credentials secure, and take responsibility for activity that happens under your account. Tell us at support@orken.app if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Break the law, infringe anyone's rights, or use the Service to harass, threaten, defraud or harm another person.
- Post content that is illegal, hateful, sexually explicit, violent, deceptive, or that promotes self-harm, eating disorders, or dangerous practices.
- Attempt to gain unauthorised access to the Service, other users' accounts, or our infrastructure; probe or test our systems without written permission; or interfere with normal operation.
- Reverse engineer, decompile, or attempt to extract source code except where that restriction is prohibited by law.
- Scrape, bulk-download, or resell the Service or its data; or use it to build a competing product.
- Manipulate challenge leaderboards by falsifying check-ins, using automation, or operating multiple accounts.
We may remove content and suspend or terminate accounts that break these rules.
5. Challenges and your content
Orken lets you create and join challenges, and to publish challenge titles, descriptions and habit templates ("Your Content"). You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display Your Content solely for the purpose of operating and improving the Service. This licence ends when you delete the content or your account, except for copies retained in routine backups for a limited period.
You are responsible for Your Content and confirm you have the rights to publish it. We provide reporting and blocking tools inside the app, and we review reports of content that breaches these Terms. We may remove content at our discretion where it breaches these Terms or applicable law.
Challenge scoring and leaderboards are calculated on our servers from participants' own check-ins. We may correct, recalculate or void results where we detect manipulation.
6. Premium subscriptions
Core habit tracking is free. An optional Premium subscription unlocks additional features, such as creating your own challenges.
- Subscriptions are purchased and billed through your Apple ID in the App Store. We do not process your payment details.
- Subscriptions renew automatically at the price and interval shown at purchase, unless cancelled at least 24 hours before the end of the current period.
- You manage or cancel a subscription in Settings → [your name] → Subscriptions on your iPhone — not inside Orken.
- Prices may change; we will notify you in advance, and changes never apply to a period you have already paid for.
- Refunds are handled by Apple under the App Store's terms. We cannot issue App Store refunds directly, but we will help where we can.
7. Not medical advice
Orken is a habit-tracking tool, not a medical device and not a source of medical advice. Nothing in the app — including any figure read from Apple Health — is a diagnosis, treatment, or professional recommendation. Always consult a qualified healthcare professional before making decisions about your health, and never disregard professional advice because of something you read in the app.
Health values shown in the app are supplied by Apple Health and your devices; we do not guarantee their accuracy. If you think you have a medical emergency, contact your local emergency services.
8. Your data
You own your habit data. The app can export everything to JSON or CSV at any time, and you can delete your account and its synced data from inside the app or via the account deletion page. How we handle your information is described in the Privacy Policy.
Data stored only on your device is your responsibility to back up. Uninstalling the app removes local data permanently.
9. Our intellectual property
The Orken name, logo, app, website, design and underlying software are owned by us and protected by intellectual property law. These Terms grant you a personal, limited, non-transferable, revocable licence to use the Service — not ownership of it.
Apple, the Apple logo, App Store, iPhone, Apple Health, Face ID, Touch ID and Siri are trademarks of Apple Inc. Orken is not affiliated with, endorsed by, or sponsored by Apple Inc.
10. Availability and changes
We aim to keep the Service running, but we do not promise uninterrupted availability. Features may be added, changed or removed. Because Orken works offline, an outage of our servers does not stop you tracking habits locally.
We may update these Terms. For material changes we will give reasonable notice in the app or by email. Continuing to use the Service after the change takes effect means you accept the updated Terms.
11. Ending this agreement
You may stop using the Service at any time, delete your account in the app, and remove the app from your device. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Where reasonable and lawful, we will give you notice and a chance to export your data first.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or that any particular result — such as forming a habit — will be achieved.
Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) EUR 50.
Some jurisdictions do not allow these limitations, in which case they apply to you only to the extent permitted.
14. Apple-specific terms
These Terms are between you and us, not with Apple Inc. Where you obtained Orken through the App Store, you also acknowledge:
- Apple has no obligation to provide maintenance or support for Orken.
- If Orken fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Orken.
- Apple is not responsible for addressing any claim relating to Orken, including product liability, legal or regulatory non-compliance, or consumer protection claims.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that Orken infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Governing law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose consumer law gives you the protection of your local courts and mandatory local rules, nothing here removes that protection.
